15959. Adulteration of ftg paste. IT. S. v. 750 Boxes of Fig Paste. Decree ' of condemnation and forfeiture. Product released under bond. (F. & D. No. 22108. I. S. No. 14289-x. S. No. 162.) On October 26, 1927, the United States attorney for the Southern District of Iowa, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure and condemnation of 750 boxes of fig paste, remaining in the oi'iginal unbroken packages at Davenport, Iowa, alleging that the article had been shipped by Garcia & Maggini Co., Fresno, Calif., on or about September 15, 1927, and transported from the State of California into the State of Iowa, and charging adulteration in violation of the food and drugs act. The article was labeled in part: " Paradise Brand Calif. Fig Paste packed by Garcia & Maggini Co." It was alleged in the libel that the article was adulterated in that it consisted in whole or in part of a filthy, decomposed, and putrid vegetable substance. On January 4, 1928, Garcia & Maggini Co., Fresno, Calif., having appeared as claimant for the property, judgment of condemnation was entered, and it was ordered by the court that the product be released to the said claimant upon payment of the costs of the proceedings and the execution of a bond in the sum of $3,000, conditioned in part that it should not be used or dis- posed of contrary to the provisions of the Federal food and drugs act, nor as food for human beings.
