16820. Misbranding of cottonseed meal. TJ. S. v. 500 Sacks of Cottonseed Cake or Meal. Consent decree of condemnation and forfeiture. Product released under bond. (F. & D. No. 23270. I. S. No. 07507. On December 24, 1928, the United States attorney for the District of Minne- sota, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure and condem- nation of 500 sacks of cottonseed cake or meal, remaining in the original unbroken packages at Minneapolis, Minn., alleging that the article had been shipped by the Dallas Oil & Refining Co., from Dallas, Tex., December 13, 1928, and transported from the State of Texas into the State of Minnesota, and charging misbranding in violation of the food and drugs act. The article was labeled in part: " Cottonseed Cake or Meal, Manufactured by Dallas Oil & Refining Co., Dallas, Texas. * * * Analysis Protein Basis 43 per cent." It was alleged in the libel that the article was misbranded in that the state- ment " Protein Basis 43 per cent," borne on the label, was false and misleading and deceived and misled the purchaser. On April 9, 1929, the Dallas Oil & Refining Co., Dallas, Tex., having appeared as claimant for the property and having consented to the entry of a decree of condemnation and forfeiture, judgment was entered ordering that the product be released to the claimant upon payment of costs and the execution of a bond in the sum of $1,000, conditioned in part that it be relabeled, under the super- vision of this department, with its correct protein content.
