19063. Misbranding of Gray's Helpnall. V. S. v. 38 Packages of Gray's Helpnall. Default decree of condemnation, forfeiture, and de- struction. (F. & D. No. 27257. I. S. No. 38935. S. No. 5402.) Examination of a drug product, known as Gray's Helpuall, from the ship- ment herein described having shown that the labeling bore statements repre- senting that the article possessed curative and therapeutic properties which it did not possess, the Secretary of Agriculture reported that matter to the United States attorney for the District of Massachusetts. On November 17, 1931, the United States attorney filed in the District Court of the United States for the district aforesaid a libel praying seizure and condemnation of 38 packages of Gray's Helpuall, remaining in the original unbroken packages at Boston, Mass., alleging that the article had been shipped by the Gray Helpuall Co., from Hillsboro, N. H., on or about June 6, 1931, and had been transported from the State of New Hampshire into the State of Massachusetts, and charging misbranding in violation of the food and drugs act as amended. Analysis of a sample of the article by this department showed that it con- sisted essentially of peppermint oil, camphor, methyl salicylate, and petrolatum. It was alleged in the libel that the article was misbranded in that the following statements regarding the curative or therapeutic effects of the said article, appearing in the labeling, were false and fraudulent, since it contained no ingredient or combination of ingredients capable of producing the effects claimed: (Tube label) "For * * * Catarrh * * * Bronchitis, Ton- silitis, Rheumatism * * * For Sore Throat and Croup * * * For Other Ailments * * * effective * * * preparation for the relief of * * * Tonsilitis, Bronchitis, Sore Throat, Rheumatism, * * * Eczema, Piles;" (retail carton) "Effective * * * Preparation For the Relief of * * * Tonsilitis, Bronchitis, Sore Throat, Rheumatism, * * * Eczema, Piles, * * * Helpuall * * * for Relieving Inflammation * * * for * * * catarrh insert Helpuall in each nostril * * * For * * * bronchitis, tonsilitis, rheumatism, * * * etc., * * * For sore throat and croup * * * For other ailments;" (circular) "Preparation to relieve inflamma- tion; particularly effective in the treatment of * * * infections of the respiratory orKans. * * * It is especially recommended for counteracting: * * * Tonsilitis, Bronchitis, Sore Throat, Rheumatism, * * * Eczema, Piles, * * * Acts Through The Pores * * * has the penetrative prop- erty of being readily absorbed by the pores of the skin.
