10686. Adulteration of frozen tullibees. U. S. v. 250 Boxes of Frozen Tulli- bees. Default decree of condemnation, forfeiture, and destruc- tion. (F. & D. No. 27786. I. S. No. 29070. S. No. 5882.) Frozen tullibees taken from the import shipment involved in this action were found, upon examination, to be infested with the cysts of parasitic worms. On February 26, 1932, the United States attorney for the Southern District of New York, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for the district aforesaid a libel praying seizure and condemnation of i50 boxes of frozen tullibees at New York, N. Y., alleging that the article had been shipped by the Rousseau Lumber Co., from Winnipeg, Manitoba, Canada, on or about February 17, 1932, to New York, N. Y., and charging adulteration in violation of the food and drugs act. It was alleged in the libel that the article was adulterated in that it con- sisted in part of a filthy, decomposed, and putrid animal substance, and in that it consisted of portions of animals unfit for food. On March 14, 1932, no claimant having appeared for the property, judgment of condemnation and forfeiture was ent6red, and it was ordered by the court that the product be destroyed by the United States marshal.
