19883. Adulteration and Misbranding of fluidextract of ginger. U. S. v. 10 Cans of Fluidextract of Ginger. Default decree of condemna- and destruction. (F. & D. No. 28224. I. S. No. 43328. S. No. 6083.) This action involved a shipment of fiuidextract of ginger, represented to be of pharmacopoeial standard, which was found upon examination to contain castor oil and but little ginger extractive. The label of the article also bore unwarranted curative and therapeutic claims. On April 28, 1932, the United States attorney for the Western District of Pennsylvania, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States, for the district aforesaid a libel praying seizure and condemnation of 10 cans of fiuidextract of ginger, remaining in the original unbroken packages at Pittsburgh, Pa., alleging that the article had been shipped in interstate commerce on or about March 24, 1930, by the Deluxe Packing Co., from Brooklyn, N. Y., to Pittsburgh, Pa., and charging adulteration and misbranding in violation of the food and drugs act as amended. The article was labeled in part: " Fluid Extract of Ginger U. S. P." It was alleged in the libel that the article was adulterated in that it was sold under a name recognized in the United States Pharmacopoeia and differed from the standard of strength, quality, and purity as determined by the test laid down in the said pharmacopoeia, and its own standard was not stated on the label. Misbranding was alleged for the reason that the statement on the label, " Fluid Extract of Ginger U. S. Pharmacopoeia," was false and misleading. Misbranding was alleged for the further reason that the statement on the label regarding the curative and therapeutic effects of the article, " Can be used in relieving Cramps," was false and fraudulent. On September 6, 1932, no claimant having appeared for the property, judg- ment of condemnation was entered and was ordered by the court that the product be destroyed by the United States marshal.
