21077. Adulteration of apple butter. IT. S. v. 95 Cases of Apple Butter. Default decree of condemnation, forfeiture, and destruction. (F. & D. no. 29766. Sample no. 26550-A.) This case involved an interstate shipment of apple butter that was found to contain insects. On January 21, 1933, the United States attorney for the District of Maryland, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 95 cases of apple butter at Cum- berland, Md., alleging that the article had been shipped in interstate commerce, on or about September 13, 1932, by the National Fruit Product Co., from Win- chester, Va., and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part: (Jar) "Mt. Vernon Brand Apple Butter National Fruit Product Company, Incorporated, Washington, D.C." It was alleged in the libel that the article was adulterated in that it con- sisted in whole or in part of a filthy vegetable substance. On June 15, 1933, the claimant having decided not to contest the action, judg lent of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
