21410. Adulteration of blueberries. U. S. v. 11 Crates and 24 Crates of Blueberries. Default decrees of condemnation, forfeiture, and destruction. (F. & D. nos. 31136, 31140. On August 31 and September 1, 1933, the United States attorney for the Northern District of Ohio, acting upon reports by the Secretary of Agriculture, filed in the district court libels praying seizure and condemnation of 35 crates of blueberries at Cleveland, Ohio, alleging that the article had been shipped in interstate commerce on or about August 29 and August 30, 1933, by Kostick Bros., acting for the Spring Mountain Blueberry Association of Beaver Meadow, Pa., from Hazleton, Pa., and charging adulteration in violation of the Food and Drugs Act. It was alleged in the libels that the article was adulterated in that it con- sisted in whole or in part of a filthy, putrid, and decomposed vegetable substance. On October 13,1933, no claimant having appeared for the property, judgments of condemnation and forfeiture were entered, and it was ordered by the court that the product be destroyed by the United States marshal.
