Sample packages of butter delivered for shipment in interstate commerce were found to contain less than 1 pound, the weight declared on the label On June 13, 1934, the United States attorney for the Western District of Washington, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of three cases of butter at Seattle, Wash., which had been delivered to the transportation com- pany, on or about June 11, 1934, by Swift & Co., for shipment in interstate commerce, to Alaska, alleging that the article was misbranded in violation of the Food and Drugs Act The article was labeled in part: " Swift's Premium Quality Brookfleld Butter 1 Lb. Net Wt." The libel alleged that the article was misbranded in that the statement " 1 Lb. Net Wt", borne on the label, was false and misleading.
