On August 23, 1934, the United States attorney for the Southern District of Ohio, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 110 cans of cream at Cincinnati, Ohio, alleging that the article had been shipped in interstate commerce, on or about August 21 and 22, 1934, in various lots by John A. The article was alleged to be adulterated in that it consisted in whole or in part of a filthy, decomposed, or putrid animal substance. The product being spoiled and unfit for human consumption was destroyed immediately with the consent of the consignee, the Merchants Creamery Co., Cincinnati, Ohio, and the court entered a decree of destruction as of August 23, 1934.
