This case was based on an interstate shipment of tomato paste that con- tained excessive mold. On February 7. 1935, the United States attorney for the Southern District of California, acting upon a report by the Secretary of Agriculture, filed in- the district court an information against the West Coast Packing Corpora- tion, Long Beach, Calif., alleging shipment by said company in violation of the Food and Drugs Act, on or about December 23, 1933, from the State of California into the State of New York of a quantity of tomato paste which was adulterated. The article was labeled in part: "Marca Seemano Brand; Salsa Di Pomidoro Tomato Paste * * * Distributors—Seeman Bros. Inc. New York." The article was alleged to be adulterated in that it consisted in part of a decomposed vegetable substance.
