25428. Adulteration of tomato puree and tomato catsup. IT. S. v. 319 Cases of Tomato Puree and 24S Cases of Tomato Catsup. Default de- cree of condemnation and destruction. (F. & D. nos. 35210, 85211. Sample nos. 22291-B, 22892-B.) This case involved tomato puree and tomato catsup which contained excessive mold. On March 4, 1935, the United States attorney for the Western District of Wisconsin, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 319 cases of tomato puree and 248 cases of tomato catsup at Madison, Wis., alleging that the articles had been shipped in Interstate commerce on or about December 5, 1934, by the Cicero Canning Co., from Cicero, Ind., and charging adulteration In violation of the Food and Drugs Act The articles were alleged to be adulterated in that they consisted wholly or in part of decomposed vegetable substances. On April 9, 1935, no claimant having appeared, judgment of condemnation was entered and it was ordered that the products be destroyed. M. L. WILSON, Acting Secretary of Agriculture.
