26023. Adulteration of tomato puree. IJ. S. v. 11 Cases of Tomato Puree. De¬ fault decree of condemnation and destruction. (F. & D. no. 37370. Sample no. 52223-B.) This case involved shipments of tomato puree that contained excessive mold. On March 14, 1936, the United States attorney for the Northern District of Ohio, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 11 cases of tomato puree at Ashtabula, Ohio, alleging that the article had been shipped in interstate commerce on or about December 12, 1935, and February 24, 1936, by the Girard Canning Co., from North Girard, Pa., and charging adulteration in violation of the Food and Drugs Act. The article was labeled in part: "Girard Brand * * * Tomato Puree * * * Packed by Girard Canning Co., Brie, Pa." The article was alleged to be adulterated in that it consisted in whole or in part of a decomposed vegetable substance. On May 14, 1936, no claimant having appeared, judgment of condemnation was entered and it was ordered that the product be destroyed. W. R. GBEGG, Acting Secretary of Agriculture.
