Samples of this product were found to contain weevils. On June 25, 1937, the United States attorney for the District of Idaho, acting upon a report by the Secretary of Agriculture, filed in the district court an Information against the Idaho Canning Co., Inc., Payette, Idaho, alleging ship- ment by said company on or about July 10, August 3, and November 18, 1986, In violation of the Pood and Drugs Act, from the State of Idaho into the States of Oregon and Washington of quantities of canned peas that were adulterated. The article was labeled variously in part: "Seven Peaks or ["Arrow Rock" or "Ida Dell"! Brands * * * Packed by Idaho Canning Co. Payette Idaho." The article was alleged to be adulterated in that It consisted in whole or in part of a filthy vegetable substance.
