Samples, of this product were found to contain mold. On May 14, 1938, the United States attorney for the District of Montana, acting upon a report by the Secretary of Agriculture, filed in the district court an information against Ruby Grace Trower, trading as the Sweet Grass County Creamery at Big Timber, Mont, alleging shipment by said defendant in viola- 103216—38 5 tion of the Food and Drugs Act on or about October 12, 1937, from the State of Montana into the State of Washington of a quantity of butter that was adulterated. The article was alleged to be adulterated in that it consisted in whole or in part of a filthy, decomposed, or putrid animal substance.
