This product was found to be filthy or decomposed, or both. On August 24, 1938, the United States attorney for the Northern District of West Virginia, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of three 5-gallon cans of cream at New Martinsville, W. Va.; alleging that the article had been shipped in interstate commerce on or about August 22, 1938, by A. E. Branon from Albany, Ohio; and charging adulteration in violation of the Food and Drugs Act. The article was alleged to be adulterated in that it consisted in whole or in part of a filthy, decomposed, or putrid animal substance. On August 24, 1938, the owner having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered destroyed. HARRY L. BROWN, Acting Secretary of Agriculture.
