This product was In part decomposed. On or about August 29 and 81, 1938, the United States attorneys for the Northern and the Eastern Districts of Illinois, acting upon reports by the Secre- tary of Agriculture, filed in the district court libels praying seizure and con- demnation of 30 cases of canned spinach at Dixon, Ill., and 39 cases of canned spinach at Danville, Ill.; alleging that the article had been shipped in interstate commerce on or about March .22, 1938, by Cane Hill Canning Co. from Lincoln, Ark. (the product was invoiced by Central Canners, Inc., Fayetteville, Ark.); and charging adulteration in violation of the Food and Drugs Act. The article was alleged to be adulterated in that it consisted wholly or in part of a filthy, decomposed, and putrid vegetable substance. On October 24 and December 2$ 1938, no claimant having appeared, judgments of condemnation were entered and the product was ordered destroyed. HARRY L. BROWN, Acting Secretary of Agriculture.
