30359. Adulteration of smoked bluefins. U. S. v. Fifty 5-Pound and Ten 10-Pound Baskets of Smoked Bluefins. Consent decree of condemnation and de- struction. (F. & D. No. 45029. Sample No. 90-D.). This product contained undeclared added color and was in part decomposed. On March 15, 1939, the United States attorney for the District of Colorado, acting upon a report by the Secretary of Agriculture, filed in the district court a libel praying seizure and condemnation of 60 baskets of smoked bluefins at Denver, Colo., consigned by Southwestern Smoked Fish Co.; alleging that the article had been shipped in interstate commerce on or about March 4, 1939, from Chicago, Ill. and charging adulteration in violation of the Food and Drugs Act. The article was alleged to be adulterated in that it was colored in a manner whereby inferiority was concealed; and in that it consisted wholly or in part of a decomposed animal substance. On March 27, 1939, the shipper having signed authorization for the taking of final decree, judgment of condemnation was entered and the product was ordered destroyed. HABBT L.
