This product was infested with parasitic worms. On April 3 and 5, 1939, the United States attorneys for the Western District of Pennsylvania and the Southern District of West Virginia, acting upon reports by the Secretary of Agriculture, filed in their respective district courts libels praying seizure and condemnation of 983 boxes of ocean perch at Pittsburgh, Pa., and 34 boxes of ocean perch at Charleston, W. Va.; alleging that the article had been shipped in interstate commerce on or about March 18 and 21, 1939, by the Great Atlantic & Pacific Tea Co. from Boston, Mass.; and charging adulteration in violation of the Food and Drugs Act. 166317°—39 4 The article was alleged to be adulterated in that it consisted wholly or in part of a filthy animal substance.
