This product was infested with parasitic worms. On April 11, 1939, the United States attorney for the Northern District of Illinois, acting upon a report by the Secretary of Agriculture, filed in the dis- trict court a libel praying seizure and condemnation of 400 boxes of ocean perch at Chicago, Ill.; alleging that the article had been shipped in interstate commerce on or about March 21, 1939, by the Cape Ann Cold Storage Co. from Gloucester, Mass.; and charging adulteration in violation of the Food and Drugs Act The article was labeled in part: "Cape Ann Ocean Perch." Adulteration was alleged in that the article consisted wholly or in part of a filthy animal substance. On May 31, 1939, the consignee having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered disposed of for fertilizer. GROVER B.
