This product was found upon examination to contain less than 80 percent by weight of milk fat. On March 1,1939, the United States attorney for the District of North Dakota, acting upon a report by the Secretary of Agriculture, filed in the district court an information against the Mandan Creamery & Produce Co., a corporation, Mandan, N. Dak., alleging shipments by it in violation of the Food and Drugs Act, on or about September 27, 1937, and August 3, 1938, from the State of North Dakota into the States of New York and Massachusetts of quantities of butter that was adulterated. Adulteration was alleged in that a product containing less than 80 percent by weight of milk fat had been substituted for butter, a product which should contain not less than 80 percent by weight of milk fat, as* prescribed by the act of March 4, 1923.
