This product contained less than 80 percent by weight of milk fat. On November 20, 1939, the United States attorney for the Southern District of Iowa, acting upon a report by the Secretary of Agriculture, filed in the district court an information against the Boone Dairy, Inc., Boone, Iowa, alleging shipment by said company in violation of the Food and Drugs Act on or about August 25, 1938, and May 22, 1939, from the State of Iowa into the State of Illinois, of quantities of butter that was adulterated. Adulteration was alleged in that a product containing less than 80 percent by weight of milk fat had been substituted for butter, a product which should contain not less than 80 percent by weight of milk fat as prescribed by the act of March 4, 1923. On December 2, 1939, a plea of guilty having been entered on behalf of the defendant, the court imposed a fine of $200 and costs. GBOVEB B. HIIX, Acting Secretary of Agriculture.
