This product consisted in part of moldy berries. On September 16, 1939, the United States attorney for the Western District of Washington, acting upon a report by the Secretary of Agriculture, filed an information against William G. Allen, trading as Allen Fruit Co., Salem, Oreg., alleging shipment by said defendant in violation of the Food and Drugs Act, on or about March 4, 1939, from the State of Washington into the State of Oklahoma, of a quantity of strawberries which were adulterated. The article was alleged to be adulterated in that it consisted in whole or in part of a decomposed vegetable substance. On March 11, 1940, a plea of guilty was entered by the defendant and the court imposed a fine of $25 and costs. PAUL V. MCNUTT, Administrator.
