On or about August 24, 1939, the United States attorney for the Southern District of Texas filed a libel against 28 cartons of candy at Houston, Tex., alleging that the article had been shipped in interstate commerce on or about November 5, 1938, by the Chicago Candy Association from Chicago, Ill.; and charging that it was adulterated in that it consisted wholly or In part of a filthy substance. It was labeled in part: "Bunte Chicago Tangos." On September 27, 1939, no claimant having appeared, judgment of condem- nation was entered and the product was ordered destroyed.
