599. Adulteration of celery. U. S. v. 45 Crates of Celery Default decree of condemnation and destruction. (F. D. C. No. 1751. Sample No. 3821-E.) This product bore arsenic and lead spray residue. On April 3, 1940, the United States attorney for the Western District of New York filed a libel against 45 crates of celery at Buffalo, N. Y., alleging that the article had been shipped in interstate commerce on or about March 4, 1940, by the Pioneer Vegetable Exchange, Inc., from Los Angeles, Calif.; and charging that it was adulterated in that it bore or contained added poisonous or deleterious substances, namely, arsenic and lead, which might have rendered it injurious to health. The article was labeled in part: "Golden Heart Kole- Pak Brand." On April 29, 1940, no claimant having appeared, a decree of condemnation was entered and it was ordered that the product be destroyed.
