747. Adulteration of butter. U. S. v. 45 Tubs of Butter. Consent decree of condemnation. Product released under bond to be re-worked. (F. D. C. No. 2619. Sample Nos. 30534-E, 30538-E.) On or about August 8, 1940, the United States attorney for the Northern District of Illinois filed a libel against 45 tubs of butter at Chicago, Ill., alleging that the article had been shipped in interstate commerce on or about July 15, 1940, by the A. T. Crouch Creamery Co., from Bloomer, Ark.; and charging that it was adulterated in that a product containing less than 80 percent by weight of milk fat had been substituted for butter. It was labeled in part: "The Peter Fox Sons Co. Distributors, Chicago, Til." On August 9, 1940, the claimants, the Peter Fox Sons Co., having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond conditioned that it be reworked so that it comply with the law.
