1045. Misbranding of Chinese noodles. IT. S. v. 21 Cases of Chinese Noodles. Default decree of condemnation. Product ordered delivered to a charita- ble institution. (F. D. C. No. 1940. Sample No. 12045-E.) Examination showed that these packages were filled to only one-third of their capacity. On May 9, 1940, the United States attorney for the District of Nevada filed a libel against 21 cases of Chinese noodles at Reno, Nev., alleging that the article had been shipped in interstate commerce on or about March 30, 1940, by the Majestic Paste Co. from San Franeiseo, Calif.; and charging that it was misbranded in that its containers were so made, formed, or filled as to be mis- leading. It was labeled in part: (Packages) "Chinese Noodles * * * Majestic Brand." On June 14, 1940, no claimant having appeared, judgment of condemnation was entered and the product was ordered delivered to a charitable institution.
