1071. Adulteration of butter. IT. S. v. 34-23/30 Cases and 3 Millers of Butter. Consent decree of condemnation. Product ordered released under bond. (F. D. C. No. 3173. Sample No. 16171-E.) On September 26, 1940, the United States attorney for the District of Kansas filed a libel against 34 23/30 cases of print butter and 3 millers (cubes) of butter at Kansas City, Kan., alleging that the article had been shipped in interstate commerce on or about September 18, 1940, by the Harding Cream Co. from Kansas City, Mo.; and charging that it was adulterated. The print butter was labeled in part: "Springtime Brand Butter Churned By Talbot, Woods & Co. Kansas City, Kans." It was alleged to be adulterated in that a valuable constituent, milk fat, had been in whole or in part omitted or abstracted therefrom; and in that a substance containing less than 80 percent by weight of milk fat had been sub- stituted wholly or in part for butter. On October 3, 1940, Talbot, Woods & Co., Kansas City, Kans., claimant, hav- ing admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond conditioned that it be brought into compliance with the law under the supervision of the Food and Drug Administration.
