1159. Adulteration of apple chops. U. S. v. 433 Bags of Apple Chops. Default decree of condemnation and destruction. (F. D. C. No. 2269. Sample No. 10533-B.) This product had been shipped in interstate commerce and was in interstate commerce at the time of examination, at which time it was found to be insect-infested and dirty. On June 26, 1940, the United States attorney for the Southern District of New York filed a libel against 433 bags of apple chops at New York, N. Y., alleging that the article had been shipped in interstate commerce on or about May 22, 1940, by Max Ams, Inc., from Philadelphia, Pa.; and charging that it was adulterated in that it consisted in whole or in part of a filthy substance. On July 10, 1940, no claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed.
