1296. Adulteration of: grilled mushrooms. IT. S. v. 135 Cans and 12 Gases of Grilled Mushrooms. Default decrees of condemnation and destruction. (F. D. C. Nos. 2456, 2693. Sample Nos. 33733-E, 33857-E.) This product was decomposed. On July 27 and August 28, 1940, the United States attorney for the Southern District of New York filed libels against 135 cans and 12 cases of grilled mush- rooms at New York, N. Y., alleging that the article had been shipped in inter- state commerce within the period from on or about February 2 to on or about June 14,. 1940, by Turin's Inn from Hazleton, Pa.; and charging that it was adulterated, in that it consisted in whole or in part of a decomposed sub- stance. One lot was labeled in parti (Cans) "Lily White Brand. Grilled Mush- rooms * * * sold by R. H. Macy & Co. New York." The remaining lot was labeled in part: "Connoisseur Grilled Mushrooms * * * Packed for Jules Weber Incorporated New York." On August 15 and September 23, 1940, no claimant having appeared, judgments of condemnation were entered and .the product was ordered destroyed.
