1565. Adulteration of frozen eggs. U. S. v. 200 Cans of Frozen Whole Eggs. Consent decree of condemnation. Product ordered released under bond. (F. D. C. No. 4738. Sample No. 53317-E.) Examination of this product showed the presence of decomposed eggs. On May 8, 1941, the United States attorney for the Southern District of Cali- fornia filed a libel against 200 cans of frozen eggs at Los Angeles, Calif., alleging that the article had been shipped in interstate commerce on or about April 8, 1941, by the Idaho Egg Producers from Caldwell, Idaho; and charging that it was adulterated in that it consisted in whole or in part of a decomposed sub- stance. It was labeled in part: "Idaho Best Frozen Egg Meats." On May 26, 1941, R. E. Bivens, claimant, having admitted the allegations of the libel and having consented to the entry of a decree, judgment of condemna- 420182°—41 3 tion was entered, and the product was ordered released under bond conditioned that it be made to conform to the law under the supervision of the Food and Drug Administration. The unfit portion was segregated and destroyed.
