1769. Misbranding of pork and bKans. U. S. v. 80 Cases of Canned Pork and BKans. Consent decree of condemnation. Product released under bond for relabeling. (F. D. C. No. 3652. Sample No. 38869-E.) This product was short weight. On January 10, 1941, the United States attorney for the District of Minne- sota filed a libel against 80 cases of canned pork and beans at Minneapolis, Minn., alleging that the article had been shipped in interstate commerce on or about November 7, 1940, by the Friday Canning Corporation from New Rich- mond, Wis.; and charging that it was misbranded. The article was labeled in part: (Cans) "Armour's Star * * * Pork and BKans. * * *• 1 Lb. 12 Oz. Net." It was alleged to be misbranded in that the statement "1 Lb. 12 Oz. Net" was false and misleading since it was incorrect; and in that it was in package form and did not bear an accurate statement of the quantity of the contents. On February 25, 1941, the Friday Canning Corporation, claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond conditioned that it be prop- erly relabeled.
