On August 21, 1941, the United States attorney for the Northern District of Illinois filed a libel against 813 15-pound boxes of haddock fillets at Chicago, 111., alleging that the article had been shipped in interstate commerce on or about August. 5, 1941,. by L. B. Goodspeed, Inc., from Boston, Mass.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed sub- stance. The article was labeled in part: "Fancy Frosted Haddock [or "Small Haddock"] Fillets." On September 5, 1941, L. B. Goodspeed, Inc., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for salvaging the good portion under the super- vision of the Food and Drug Administration.
