Samples of these products were found to contain, variously, insect and rodent filth, and certain of the pies also contained added water and starch paste. On June 11, 1941, the United States attorney for the Eastern District of Penn- sylvania filed an information against John E. Mayer, of Philadelphia, Pa., alleging delivery for introduction in interstate commerce from the State of Pennsylvania into the State of New Jersey on or about July 6, 1940, of quantities of cakes and pies that were adulterated. The articles were alleged to be adulterated in that they consisted in whole or in part of filthy substances; portions of the pies were alleged to be adulterated further in that water and starch had been substituted in part for peach, pineapple, raisin, apple, and cherry fruit therein. On October 2,1941, the defendant having pleaded nolo contendere, judgment of guilty was entered by the court and a fine of $200 was imposed.
