Pn December 23, 1941, the United States attorney for the Northern District of Illinois filed a libel against 39 boxes of apples at Chicago, Ill., alleging that the article had been shipped in interstate commerce on or about November 8, 1941, from Yakima, Wash., by the W. E. Roche Fruit Co.; and charging that it was adulterated in that it contained added poisonous or deleterious ingre- dients, arsenic and lead, which might have rendered it harmful^to health. The article was labeled in part: "Ex Fancy Jonathan * * * Yak Brand." On January 20, 1942, the consignee having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered; destroyed.
