3083. Adulteration of frozen strawberries. U. S. v. 110 Barrels of Frozen Straw¬ berries. Default decree of condemnation and destruction. (F. D. C. No, 6828. Sample No. 84025-E.) Examination of this product showed the presence of moldy berries. On or about February 10, 1942, the United States attorney for the Southern District of New York filed a libel against 110 barrels of frozen strawberries at Bronx [New York], N. Y., alleging that the article had been shipped in interstate commerce on or about September 4, 1941, by Mukai & Son from Vashon, Wash.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed substance. The article was labeled in part: "Rock Garden Brand 4&1 Marshall Strawberries No. 2." On March 2, 1942, no claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed. CANNED FRUITS
