3558. Adulteration of tomato paste., TJ. S. v. 74 Cases of Tomato Paste. Consent decree of condemnation. Product ordered released under bond to be reconditioned. (F. D. C. No. 6888. Sample No. 95081-E.) On February 19, 1942, the United States attorney for the Western District of Washington filed a libel against 74 cases, each containing 100 cans, of tomato paste at Seattle, Wash.,- alleging that the article, had been shipped in interstate commerce on or about February 5, 1942, by Schwabacher Bros. & Co., Inc., from Oakland, Calif.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed substance. The article was labeled in part: (Cans) "Motta Brand Extra Fancy Pure Tomato Paste Net Weight 6% Oz: Packed By Flotill Products Incorporated Stockton California." r On March 20, 1942, Flotill Products, Inc., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond to be reconditioned under the supervision of the Food and Drug Administration. The unfit portion was segregated and destroyed.
