On March 31 and April 15, 1942, the United States attorney for the Western District of Pennsylvania filed libels against 25% cases, each full case con- taining 24 cans, of spaghetti sauce at Erie, Pa., alleging that the article had been shipped in interstate commerce on or about March 5, 1942, by Ragu Packing Co. from Rochester, N. Y.; and charging that it was adulterated in that it consisted in whole or in part of a decomposed substance. The article was labeled in part: (Kans.) "Ragan Brand Contents 10% Ozs. * * * Ital- ian Style Spaghetti—Sauce." On May 13 and 19, 1942, no claimant having appeared, judgments of con- demnation were entered and the product was ordered destroyed.
