On July 6 and July 13,1942, the United States attorney for the Southern Dis- trict of New York filed libels against a total of 42 tubs, each containing 64 pounds, of butter at New York, N. Y., alleging that the article had been shipped in inter- state commerce on or about June 29 and July 6, 1942, by the Orange Creamery from Orange, Va.; and charging that it was adulterated in that a product con- taining less than 80 percent by weight of milk fat had been substituted for butter. • The article was labeled in part: "Butter Distributed by J. R. Kramer, Inc. * * * New York, N. Y." On July 21 and 29, 1942, the Orange Creamery, claimant, having admitted the allegations of the libels, judgments of condemnation were entered and the product was ordered released under,bond for reworking under the supervision of the Food and Drug Admin intra tion so that it contain at least 80 percent of milk fat. :/.'. -
