4055. Adulteration of canned spaghetti. U. S. v. 73 Cases of Canned Spaghetti. Default decree of condemnation and destruction. (F. D. C. No. 7333. Sample No. 87475-B.) The-tomato sauce in this canned spaghetti contained mold, indicating the presence of decomposed material. On April 14,1942, the United States attorney for the Southern District of West Virginia filed a libel against 73 cases each containing 48 cans of spaghetti at Huntington, V^. Va., alleging that the article had been shipped in interstate commerce on or about February 9, 1942, by Phillips Sales Co:* from Cambridge, Md.; and charging that it was adulterated in that it consisted wholly or in part of a decomposed substance. The article was labeled in part: "Phillips Delicious Cooked Spaghetti with Tomato Sauce and Cheese."
