On September 11, 1942, the United States attorney for the Eastern District of Pennsylvania filed a libel against 74 40-pound boxes of cheese at Philadelphia, Pa., alleging that the article had been shipped in interstate commerce on or about August 17,1942, by Scoville, Brown & Co., from Wellsville, N..Y.; and charging that it was adulterated in that It consisted in whole or in part of a filthy substance, and in that it had been prepared under insanitary conditions whereby it might have become contaminated with filth. On October 23, 1942; Scoville, Brown & Co., claimants, having appeared, judg- ment of condemnation wag entered and the product was ordered released under bond to be sold for purposes other than for human consumption, arid to be dena- tured under the supervision of the Food and Drug Administration.
