4422. Misbranding of canned peas. U. S. v. 550 Cases of Canned Peas. Default decree of condemnation and sale. (F. D. C. No. 8645. Sample No. 5756—F.) On October 26, 1942, the United States attorney for the Eastern District of Missouri filed a libel against 550 cases, each containing 24 cans, of peas at St. Louis, Mo., alleging that the article had been shipped in interstate commerce on or about September 17,1942, by the Oostburg Canning Co. from Oostburg, Wis. J and charging that it was misbranded since it was below standard. The article was labeled in part: (Can) "Oostburg Extra Sifted Early June Peas" On December 29,1942, no claimant having appeared, judgment of Condemnation was entered and the product was ordered,sold to the highest bidder oh condition that purchaser adopt such safeguards as might be recommended by the Food and Drug Administration against its being disposed of in violation of the law.
