On September 9, 1942, the United States attorney for the Southern District of New York filed a libel against 221 60-pound bags of yellow split peas at New York, N. Y., alleging that the article had been shipped m interstate commerce on or about January 30, 1940, from Port Huron, Mich., for the packer/the Trinir dad Bean & Elevator Co., Denver, Colo.; and charging that it was adulterated in that it consisted in whole or in part of a filthy substance. On November 5, 1942, the Raymond-Hadley Corporation, New York, N. Y., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for washing and cleaning, and causing the peas that were wormy, moldy and otherwise unfit, to be segregated and destroyed, under the supervision of the Food and Drug Administration.
