On September 14,1942, the United States attorney for the Northern District of Texas filed a libel against 1,000 30-pound cartons of whole eggs at Dallas, Tex., alleging that the article had been shipped in interstate commerce on or about June 5,1942, by the Blue Diamond Products Co. from Council Bluffs, Iowa; and charging that it was adulterated in that it consisted wholly or in part of a filthy substance, decomposed eggs. On October 17, 1942, the Blue Star Produce, Inc., and Hennlngsen Brothers, Inc., of Fort Worth, Tex.j having appeared as claimant and having admitted the allegations of the libel and consented to the entry of a decree, judgment of con- demnation was entered and the product was ordered released under bond condi- tioned that the good be separated from the bad under the supervision of the Food and Drug Aministration, so that the good portion could be sold for human consumption.
