5494. Adulteration of frozen fish. XT. S. v. 193 Cartons of a product labeled "dressed Croakers," and 37 boxes of Unlabeled Fish. Default decree of condemnation. Product ordered sold for manufacture intd fertilizer, or destroyed. (F. D. C. No. 10525. Sample No. 25668-F.) On September 1, 1943, the United States attorney for the Northern District of Alabama filed a libel against 193 15-pound cartons of croakers and 37 unlabeled boxes containing about 4,995 pounds of fish at Birmingham, Ala., alleging that the article had been shipped in interstate commerce on or about July 29, 1943, from New Orleans, La., for the account of Irvington Fish and Oyster Co., Inc., Irvington, Va.; and charging that it was adulterated in that it consisted in whole or in part of decomposed animal substance. On October 23, 1943, no claimant haying appeared, judgment of condemnation was entered and the product was ordered sold to be manufactured into fertilizer, or destroyed.
