On September 10, 1943, the United States attorney for the Northern District of Illinois filed a libel against 310 cartons of butter at Chicago, Ill., alleging that the article had been shipped' in interstate commerce on or about May 11 1943, by the Fort Smith Creamery Company from Fort Smith, Ark.*; and charging that it was adulterated in that a product containing less than 80 percent by weight of milk fat had been substituted for butter. It was labeled in part: (Tracing) "The Peter Fox Sons Co. Chicago, Ill." On November 1, 1943, Peter Fox Sons Co., claimant, having admitted the facts set forth in the libel, judgment of condemnation was entered and the product, was ordered released under bond for reworking under the supervision of the Food and Drug Administration.
