LIBEL FILED : December 4,1913, Eastern District of Missouri. ALLEGED SHIPMENT : On or about October 28, 1943, by H. Sagel, Wildwood, N. J. PRODUCT: 15 cases, each containing 43 boxes, of candy at St. Louis, Mo. LABEL IN PART: "Real Sea Shore Salt Water Taffy." VIOLATIONS CHARGED: Misbranding, Section 403 (a), the statement on the label, "Net 16 Ounces," was false and misleading as applied to an article that was short-weight; and, Section 403 (e) (2), it was food in package form and failed to bear a label containing an accurate statement of the quantity of the contents. DISPOSITION : January 21, 1944. No claimant having appeared, judgment of condemnation was entered and the product was ordered sold on condition that it should not be disposed of in violation of the law.
