Sample No. 66608-F.) LIBEL FILED : April 4,1944. Western District of Missouri. ALLEGED SHIPMENT : On or about February 19 and 20, 1942, from Hugo, Okla. PRODUCT: 53 bags, containing a total of approximately 6,000 pounds, of peanuts, - in the possession of the United States Cold Storage Co., Kansas City, Mo. This product had been stored under insanitary conditions after shipment. Rodent excreta pellets, rodent urine stains, and rodent-gnawed holes were noted on the bags. The peanuts were contaminated with rodent excreta and rodent hair fragments. in whole or in part of filthy substances, since it contained rodent excreta and rodent hair fragments; and, Section 402 (a) (4), it had been stored under insanitary conditions whereby it might have become contaminated with filth} DISPOSITION : May 3, 1944. United States Cold Storage Co., appeared as claim- ant. Judgment of condemnation was entered and the product was ordered re- leased under bond to be brought into compliance with the law, under the supervision of the Food and Drug Administration. The unfit portion was seg- regated and disposed of as stock feed.
