No. 12405. Sample No. 13320-F.) LIBEL FILED : May 20,1944, District of Idaho. ALLEGED SHIPMENT : On or about January 11,1944, from Sacramento, Calif. PRODUCT: 58 100-pound bags of rice in possession of the Pacific Fruit & Produce Co., Boise, Idaho. This product had been stored, after shipment, under insanitary conditions. The bags contained rodent-chewed holes, rodent excreta, and urine stains. Several mouse nests were found in the stack. Examination disclosed the presence of rodent excreta and rodent hairs. VIOLATIONS CHARGED: Adulteration, Section 402 (a) (3), in that the product consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), in that it had been held under insanitary conditions whereby it might have become contaminated with filth. DISPOSITION : August 2,1944. The Pacific Fruit and Produce Co., claimant, hav- ing admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for the segregation of the good portion from the bad, under the supervision of the Federal Security Agency, and the destruction of the unfit portion.
