VIOLATION CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substa"nce by reason of the presence of insect excreta pellets. DISPOSITION: December 1, 1943. Arthur G. Dunn, New York, N. Y., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond to be reconditioned so as to comply with the law, under the supervision of the Food and Drug Admin- istration. On December 4,1943, an amended decree was entered to permit the , reconditioning, of the product by a different firm than the one originally named. Subsequently, it was accidentally destroyed by fire.
