No. 12947. Sample No. 72558-F.) LIBEL FILED: July 19, 1944, Western District of Tennessee. ALLEGED SHIPMENT: On or about April 15, 1944, from Houma, La. PRODUCT: 115 bags, each containing 100 pounds, of sugar at Memphis, Tenn., in the possession of the General Warehouse Co. This product had been stored, after shipment, under insanitary conditions. ' Some of the bags had been gnawed by rodents and contained rodent excreta and urine stains. Examination showed that the sugar contained rodent excreta and had become contaminated with urine. VIOLATIONS CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. i ' DISPOSITION: August 2, 1944. The Realty Operators, Inc., Houma, La., claimant, having admitted the allegations of the libel, judgment of condemna- tion was entered and the product was ordered released under bond for the ' segregation and destruction or denaturing of the unfit portion. On August 8, 1944, an amended decree was entered, providing for the refining and recrystal- lization of the unfit portion, under the supervision of an officer designated by the Federal Security Agency Administrator. f
